Terms of service

These terms apply to your use of Mensorix, the app and website provided by Beauta Holdings Limited ("we", "us"), registered in England and Wales, company no. 11998644. Mensorix is a trading name of Beauta Holdings Limited.

By creating an account or using Mensorix, you agree to these terms. If you use Mensorix for a company or other organisation, you confirm that you are allowed to accept these terms on its behalf, and "you" includes that organisation.

1. Who Mensorix is for

Mensorix is a business tool for people working on construction projects. It is not intended for use as a consumer or by children.

2. The service

Mensorix is in early access. We are adding features, and some things will change as we build it. Snagging is available now; other modules shown on our website are marked "Coming soon" until they are ready. We may change, add or remove features. If we remove something you rely on, we will tell you in advance where we reasonably can.

3. Your account

• Give accurate details when you sign up and keep them up to date.
• Keep access to your email account, Google account or Microsoft account secure, as it is used to sign you in to Mensorix.
• You are responsible for what happens under your account. Tell us straight away at support@mensorix.com if you think someone else has used it.
• Your company's administrators decide who belongs to your company's account and what role they have, and can remove people.

4. Your content

Everything you or your colleagues put into Mensorix, such as projects, findings, photos, drawings, comments and signatures, remains yours. You give us permission to store, copy and process it only as needed to provide Mensorix to you, keep it secure and support you.

You are responsible for your content, including having the right to upload it and handling any personal information in it lawfully. Where your content includes personal information about other people, such as operatives or contractors, your company decides how it is used and we handle it on your company's behalf, only to provide Mensorix. Our privacy policy explains how we handle information.

5. Working with other companies

When you invite clients, consultants or subcontractors onto a project, they can see the items shared with them on that project. Check what you share before you share it. People you invite must also accept these terms.

6. Acceptable use

You must not:

• break the law, or upload anything that is unlawful, harmful or that you do not have the right to share;
• try to access accounts, projects or information you have not been given access to;
• interfere with, overload or try to break the security of Mensorix;
• copy, resell or reverse engineer Mensorix, except as the law allows.

7. Your records and responsibilities

Mensorix helps you keep your records and evidence in one place. It does not replace your own professional judgement, and it does not make you compliant with any law, regulation or contract. You remain responsible for your health and safety duties, your obligations under the Construction (Design and Management) Regulations 2015 where they apply, and your contracts.

During early access, keep your own copies of anything important, for example by exporting reports.

8. Payment

Mensorix is free to use during early access. Paid plans will be bought on our website. If you choose one, its price and terms will be shown to you before you pay. Nothing is bought in the app.

9. Availability

We aim to keep Mensorix available and working well, but we cannot promise it will always be available or free of faults. We may need to pause it for maintenance, updates or reasons outside our control.

10. Suspending or ending your use

You can stop using Mensorix at any time, and you can ask us to close your account by emailing support@mensorix.com. We may suspend or close an account if these terms are seriously or repeatedly broken, or if we need to in order to protect other users or Mensorix. Where we reasonably can, we will warn you first and give you the chance to export your content.

11. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.

Otherwise:

• we are not liable for loss of profit, revenue, business, contracts or goodwill, or for any indirect or consequential loss;
• our total liability to you in any 12-month period is limited to the greater of £100 and the amount you paid us for Mensorix in that period.

12. Changes to these terms

We may update these terms, for example when we add paid plans or new features. We will update the date at the top of this page and, for significant changes, tell you in the app or by email before they take effect. If you keep using Mensorix after that, the new terms apply.

13. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
